Terms and conditions of sale - Koul Traiteur

1. Purpose
These Terms and Conditions of Sale (TCS) aim to define the rights and obligations of the parties within the framework of the sale of products and services offered by Koul Traiteur (hereinafter referred to as "the Caterer") to its clients (hereinafter referred to as "the Client").
2. Orders
Orders must be placed via the website or by email.
An order is considered firm and final once it has been confirmed in writing by the Caterer.
The Caterer reserves the right to refuse an order if production or delivery capacities are exceeded.
3. Prices and Payment Terms
Prices are shown in Canadian dollars, excluding applicable taxes (GST and QST).
- In some cases, a 50% deposit may be required to confirm the order.
- The remaining balance must be paid no later than the day before delivery or pickup.
- Payments can be made by credit card, Interac e-transfer, or other methods specified on the website.
4. Delivery Fees
Delivery fees may apply depending on the distance or the size of the order. These fees are indicated at the time of ordering and are subject to GST and QST.
5. Cancellation and Modification
- Any cancellation must be communicated in writing.
- If the cancellation occurs less than 7 days before the delivery date, the Caterer reserves the right to charge all or part of the order.
- Modifications (number of portions, allergies, schedules, etc.) must be made at least 7 days before delivery and are subject to approval.
6. Liability
The Caterer commits to providing quality products in compliance with hygiene and health standards.
However, they cannot be held liable for:
- Delays caused by force majeure events (weather, breakdowns, strikes, etc.)
- Errors or omissions resulting from incomplete or incorrect information provided by the Client.
7. Allergies and Dietary Restrictions
The Client is responsible for communicating any allergies or dietary restrictions. The Caterer will take reasonable precautions but does not guarantee the complete absence of allergens (possible traces of gluten, etc.).
8. Intellectual Property
All site content (texts, photos, logos) is the exclusive property of the Caterer and may not be reproduced without written permission.
9. Governing Law
These Terms and Conditions of Sale are governed by the laws of the province of Quebec and the applicable federal laws of Canada.
